Arrested or charged in Denmark? Talk to a defence lawyer first
Being questioned, arrested or charged in a foreign country is overwhelming. You have rights in Denmark, and you can choose your own defence lawyer. Attorney Jens Lang Rask is a former public prosecutor with more than 10 years of experience in criminal cases. We advise in English, Danish and Arabic.
Your rights, in plain English
THE RIGHT TO REMAIN SILENT
You do not have to make a statement
If you are a suspect, the police must tell you what you are suspected of and that you are not obliged to make a statement. You have the right to talk to a defence lawyer before you are questioned. You only have to give your name, address and date of birth.
THE RIGHT TO A LAWYER OF YOUR CHOICE
Ask for Jens Lang Rask by name
Tell the police that you want Advokatfirmaet Jens Lang Rask appointed as your defence lawyer. If you are arrested, you must be brought before a judge within 24 hours, and we attend the hearing. You also have the right to an interpreter.
Fees, and who pays
COURT-APPOINTED
The state pays up front
In cases that may lead to more than a fine, the court appoints a defence lawyer and the state advances the fee. The hourly rate is set by the court and is the same whichever lawyer you choose.
IF YOU ARE ACQUITTED
The state pays
If you are acquitted, the state as a rule pays the full fee. If you are convicted, you may be ordered to repay the costs of the case.
NOT A CITIZEN?
Expulsion is a separate risk
For non-Danish citizens, a conviction may lead to expulsion. This must be part of the defence from day one. Read about expulsion (in Danish).

Frequently asked questions
I was arrested as a tourist. What happens now?
You must be brought before a judge within 24 hours. The judge decides whether you are released or remanded in custody. Ask for your own defence lawyer and an interpreter, and do not make a statement until you have spoken to your lawyer.
Do I have to talk to the police?
No. As a suspect you are not obliged to make a statement. You must only give your name, address and date of birth. Talk to your defence lawyer first.
Will I get an interpreter?
Yes. If you do not speak Danish, you are entitled to an interpreter during police questioning and in court.
Can I leave Denmark while the case is ongoing?
It depends on the case. In some cases you must stay or appear in court on a set date. Talk to us before you travel, so the case is not decided without you.
How much does a defence lawyer cost?
If the court appoints us, the state advances the fee at the official hourly rate. If you are acquitted, the state as a rule pays. The first consultation is free.
